There are two main types of probate administration in Florida. First, formal administration or “regular” administration and summary administration (for estates with assets totaling less than $75,000). There is also a non-court supervised administration proceeding called “Disposition of Personal Property Without Administration.” This type of administration only applies in limited circumstances. Probate administration only applies to certain assets probate assets. Those are assets that the decedent owned in his or her sole name at death, or that were owned by the decedent and one or more co-owners and lacked a provision for automatic passing of ownership at death.  As a result, most estates have some assets that need to go through the probate process.

  • Life insurance policies, annuities contract, or individual retirement accounts that were made payable to the decedent’s estate.
  • Real estate titled in the sole name of the decedent, or in the name of the decedent and another person as tenants in common, is a probate asset. Homestead properties and properties titled to both spouses as tenant by the entireties.
  • Automobiles, boats, RVs & other vehicles titled only in the decedent’s name.
  • Stocks and bonds held individually.
